For years, beginning in 1979, I began believing that we should fight the energy crisis as if it were equivalent to a national war. So like anyone interested in a subject, I began researching and studying renewable energy technologies, environment and natural resources. Some where or maybe at the beginning I became interested in politics.

 

I began publishing books, built websites and gave away free my publications either in book forum or the internet in a web site known as energyquestsearch.com, no longer on line.

 

In 1995, the California Energy Commission trademarked Energy Quest and built a web site using my books title and began educating the public about renewable energy technologies and energy efficient devices/products like I was doing.

 

In my view, I was ripped off and there was no way I could match California’s resources, yet for years I have tried, hoping someone in congress could review the gray area between copyright and trademark where it relates to a product as a result of books, i.e., educating the public on renewable energy, etc.

 

In my view, my intellectual property was stolen and the creation of Energy Quest by its author, EQNEEDF, me, not Ca. Energy Commission, for the purpose aforementioned, in which the author published first, prior to Ca. Energy Commission obtaining the trademark, testifies to the legal theft.

 

I guess the law says you can screw citizens out of there ideas in print as long as you trademark the title of the book where the ideas came from, using the authors published ideas to build your own similar platform of educating the public the same subject to author tried to do.

 

Since I got screwed without a kiss or even a thank you for the idea published in my books, to include educating the public about aforementioned subjects, I hope selling my books publicly to anyone or entity in the world, results in famous scientist coming together to publish books for profit, since I can’t compete with the California Energy Commission, under the Titles:

Years ago when I thought renewable energy technologies would be presented to the public much differently, Energy Quest publications were offered but only the CALIFORNIA ENERGY COMMISSION responded by trade marketing my books name, ownership by EQNEEDF established in 1979.

 

Talk about getting ripped off and buy a state agency, well at least someone thought Energy Quest was useful. I feel like I got screwed because I had a broken neck and couldn’t fight so I contacted every elected official and not one gave a flying hoot.

When an entity uses another persons product that is copyrighted (four separate books titled ENERGY QUEST) to do the same thing the owner of ENERGY QUEST has done or is doing, me, can such a trademark be fairly granted or can I or anyone trademark the title of anyone’s work of authorship that is copyrighted if in fact the entity that acquired a trademark, does the exact same thing with the title that the author has and is doing?

 

If trade marking anyone’s book title is legal, then the title “America is Screwed,” could be viable if the author didn’t trademark his book title, yet in doing so, I don’t see where a similarity would occur for any product that could be sold as a result of trade remarking this book title other then having acquired a spiffy name for a Shirt or web site.

Yet I don't have to say anything in my add but if CA Energy Commission wants to educate the public there not affiliated with Energy Quest, go ahead, it will make there use of Energy Quest worthless, because anyone who owns these copyrights can legally advertise the product as Energy Quest.

 

Either CA ENERGY COMMISSION or I, the EQNEEDF, CEO and President of Energy Quest Energy Efficient Development Inc. are the only ones legally allowed to advertise products under Energy Quest, although in my view the Ca. Energy Commission wrongfully acquired the trademark even though they may have had the legal right to do, questioned by me.

What I know?

 

Trademark infringement is a violation of the exclusive rights attaching to a trademark without the authorization of the trademark owner or any licensees (provided that such authorization was within the scope of the license). Infringement may occur when one party, the "infringer", uses a trademark which is identical or confusingly similar to a trademark owned by another party, in relation to products or services which are identical or similar to the products or services which the registration covers. An owner of a trademark may commence legal proceedings against a party which infringes its registration.

 

In many countries, (but not in the United States, which recognizes common law trademark rights), a trademark which is not registered cannot be "infringed" as such, and the trademark owner cannot bring infringement proceedings. Instead, the owner may be able to commence proceedings under the common law for passing off or misrepresentation, or under legislation which prohibits unfair business practices. In some jurisdictions, infringement of trade dress may also be actionable.

 

Where the respective marks or products or services are not identical, similarity will generally be assessed by reference to whether there is a likelihood of confusion that consumers will believe the products or services originated from the trademark owner.

 

Likelihood of confusion is not necessarily measured by actual consumer confusion, though normally one of the elements, but by a series of criteria Courts have established. A prime example is the test announced by the Ninth Circuit Court of Appeals in AMF, Inc v Sleekcraft Boats, 599 F.2d 341 (C.A.9) 1979. The Court there announced eight specific elements to measure likelihood of confusion:

 

Strength of the mark

Proximity of the goods

Similarity of the marks

Evidence of actual confusion

Marketing channels used

Type of goods and the degree of care likely to be exercised by the purchaser

Defendant's intent in selecting the mark

Likelihood of expansion of the product lines[1]

 

Other Courts have fashioned their own tests for likelihood of confusion—like those announced in In re E.I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (CCPA 1973), known collectively as the DuPont factors.

 

If the respective marks and products or services are entirely dissimilar, trademark infringement may still be established if the registered mark is well known pursuant to the Paris Convention. In the United States, a cause of action for use of a mark for such dissimilar services is called trademark dilution.

 

In some jurisdictions a party other than the owner (e.g. a licensee) may be able to pursue trademark infringement proceedings against an infringer if the owner fails to do so.

 

The party accused of infringement may be able to defeat infringement proceedings if it can establish a valid exception (e.g. comparative advertising) or defence (e.g. laches) to infringement, or attack and cancel the underlying registration (e.g. for non-use) upon which the proceedings are based.

In 2001 I mailed a copy of many Energy Quest Books to Larry Flint, Hustler Magazine, but he was only

interested in sex, so I was surprised he ran for Governor of California. I sent a message to him on his
